It's one of the reasons why I don't think the implementation is good. In the case of forming the HRE, it just disallows creation. In terms of restoring the Carolingian borders, it gives a big opinion penalty. Dunno why it couldn't work the same way for the HRE decision, just giving a big opinion penalty with the HRE emperor if they exist.

HRE argument only works when speaking about HRE and only internal HRE borders.. Major issue I think is because exclave independence rules in game don't apply to subjects of your vassal, it only affects to your direct vassals.
